Welcome to the forums @k9750.

How did you set up the router? Did you use an old saved backup config file from another router?

Do you have any USB drives plugged in?

If you follow the Hard Factory Reset for your model as outlined in the link below, afterward, are you able to flash it to the current version you want?

thanks for the reply
it is brand new
and after i unboxed it, i was browsing around the settings without internet, and where i was sitting, there was no LAN internet available
so i decided to try to connect to the internet through USB tethering by connecting my smartphone ( oneplus ) to the router's USB
and it worked fine
that is all i did
other than that
i did reset the router several time, using reset physical button from the back
as well as using webgui
non worked

As you found out, there is no need to connect the WAN to the router.

Remove the smartphone.

Do a full reset to factory settings as outlined in the link I provided.

Do not connect to the internet with the router at all.

Flash the updated firmware you have already downloaded.

I did reset the router using physical reset button -- and didn't connect WAN cable -- then initialized it, tried upgrade firmware --> Failed
and then did reset through webgui restore settingts + enabled tick on clear all data and did the same above .. same failed to upgrade
